Terms of Service — GetPingd

Summary: Use GetPingd fairly, don't abuse it, and you're good. We may suspend access if these terms are violated.

1. Acceptance of Terms

By adding GetPingd to your Discord server or using our dashboard at getpingd.xyz, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please remove the bot and stop using our services.

2. What GetPingd Does

GetPingd is a Discord bot that monitors content creators on platforms including Twitch, YouTube, and Kick, and delivers real-time notifications to Discord channels of your choice when a creator goes live or uploads new content.

We also provide a user dashboard where you can manage your settings, request a full export of your stored data, or exercise your right to erasure by permanently deleting your account and all associated data with a single click.

3. Eligibility

You must be at least 13 years old to use GetPingd, in accordance with Discord's Terms of Service. By using GetPingd, you confirm that you meet this requirement. Server administrators are responsible for ensuring their members' use of the bot complies with these terms.

4. Acceptable Use

When using GetPingd, you agree not to:

Use the service to send spam, unsolicited, or misleading notifications
Subscribe to creators for the purpose of harassment, abuse, or targeted disruption
Attempt to reverse-engineer, exploit, or disrupt the bot or its infrastructure
Use the service in violation of Discord's Terms of Service or Community Guidelines
Circumvent rate limits, abuse the API, or attempt unauthorized access to our systems
Impersonate GetPingd or misrepresent your affiliation with the service

Violations may result in immediate removal of access without notice.

5. Bot Permissions

GetPingd requires certain Discord permissions to function, including the ability to send messages and embeds in designated channels. You are responsible for configuring permissions correctly in your server. We are not responsible for notifications delivered to incorrect channels due to misconfiguration.

6. Third-Party Platforms

GetPingd accesses publicly available data from third-party platforms (Twitch, YouTube, Kick). We are not affiliated with, endorsed by, or responsible for the content, availability, or policies of these platforms. Changes to their APIs may affect the reliability of notifications.

7. Service Availability

We strive to keep GetPingd running reliably, but we do not guarantee 100% uptime. Notifications may be delayed or missed due to third-party API outages, maintenance, or unforeseen technical issues. We are not liable for any damages resulting from missed or delayed notifications.

8. Account Termination

We reserve the right to suspend or terminate access to GetPingd for any account or server that violates these Terms. We may do so without prior notice at our sole discretion.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of GetPingd after changes are posted constitutes your acceptance of the updated Terms.

10. Disclaimer of Warranties

GetPingd is provided "as is" without any warranties, express or implied. We do not warrant that the service will be error-free, uninterrupted, or meet your specific requirements.

11. Limitation of Liability

To the fullest extent permitted by applicable law, GetPingd and its operator(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the service.

12. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Germany.
